GeekArt Editor Terms of Service (Terms & Conditions)

• “Account” means your registered login identity for the Service.
• “Content” means (a) anything you submit to the Service (e.g., text, prompts, files, images, links) (“Input”) and (b) results generated or returned by the Service (“Output”).
• “Credits” means virtual units used to measure usage or entitlements within the Service. Credits are not legal tender, not a stored-value account, bear no interest, and are non-transferable.
• “Subscription” means a recurring paid plan billed on a periodic basis (e.g., monthly or yearly).
• “One-time Credit Pack” means a one-time purchase of Credits, which may be subject to expiration as shown at checkout.
• “Paddle” means our third-party payment and billing provider (which may include Paddle.com Market Limited and its affiliates).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must have full legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your Account credentials and for all activity under your Account.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service.

The Service is a self-serve software product and does not include human-driven services as part of your purchase. Humans may be involved only for customer support and for security/compliance purposes.

We may offer beta or trial features. Such features may change or be discontinued at any time and are provided “as is”.

You are responsible for your Input and represent that you have all rights necessary to provide it.

Output is generated automatically and may be inaccurate, incomplete, biased, or not fit for your purpose. You must independently review and verify Output and are solely responsible for your use of Output.

Output may be similar or identical to output provided to other users; we do not guarantee uniqueness or non-infringement.

Unless you explicitly opt in, we do not use your Content to train our own AI models and we do not allow third parties to train on your Content.

We may use aggregated and de-identified service metrics (excluding your Content) to improve reliability and user experience.

You may not:

• use the Service for illegal activities or to generate unlawful content;
• upload or process data you are not authorized to use (including others’ personal data or trade secrets);
• infringe third-party rights (IP, privacy, publicity, etc.);
• attempt to bypass security, scrape, reverse engineer, or disrupt the Service;
• engage in fraud, abuse, or malicious chargebacks;
• use the Service to develop or train competing models/systems (unless permitted by law and expressly approved by us in writing).

The Service may integrate or rely on third-party services (cloud, analytics, AI model providers, payments, etc.).

Payments and billing are handled by Paddle. During checkout you may also be asked to agree to Paddle’s buyer terms and privacy policy (e.g., https://www.paddle.com/legal/checkout-buyer-terms and https://www.paddle.com/legal/invoiced-consumer-terms and https://www.paddle.com/legal/privacy).

Third-party services are governed by their own terms. We are not responsible for them, but we may assist reasonably.

Pricing and billing terms are shown on our pricing/checkout pages.

Payments and billing are generally processed by Paddle as the Merchant of Record. Refunds and cancellations are governed by Section 11 and Paddle’s applicable terms and policies.

You authorize Paddle (and/or its affiliates) to charge your selected payment method for subscription fees and applicable taxes.

If you initiate a chargeback or payment dispute, please contact support@geekart.ai first. Fraudulent chargebacks may result in suspension or termination.

Subscriptions renew automatically unless cancelled. To avoid being charged for the next period, cancel at least 24 hours before renewal (or as indicated in your billing UI).

Cancelling stops future renewals but you may continue to access paid entitlements until the end of the current billing period.

One-time Credit Packs may expire (e.g., 365 days after purchase) as shown at checkout; unused Credits may expire.

We may adjust how Credits are consumed based on model costs, features, and risk controls, and will disclose such changes in-product or on relevant pages.

This Section 11 constitutes our refund policy for purchases made via https://www.geekart.ai.

Payments and billing are handled by Paddle as the Merchant of Record. Refunds and cancellations follow Paddle’s applicable terms and policies (including a minimum 14-day refund/cancellation window). See: https://www.paddle.com/legal/invoiced-consumer-terms.

11.1 14-Day Refund Window
You may request a refund or cancellation within 14 days after a transaction is completed (as per Paddle’s policy).

11.2 How to Request a Refund
You may submit a refund request via Paddle support channels, or contact us at support@geekart.ai and we will assist you with Paddle. Please include your order/transaction ID (if available) and the email used to purchase.

11.3 Refund Method and Timing
Refunds are returned to the original payment method (typically via Paddle or its payment channels). Timing depends on your bank or payment provider.

You may stop using the Service at any time.

We may suspend or terminate your access if you violate these Terms or if we reasonably believe there is fraud, abuse, or security/compliance risk.

After termination, we may retain certain records as required by law (e.g., transaction and audit records).

We and our licensors retain all rights in the Service, including software, UI, trademarks, and documentation, except for rights you retain in your Input.

To the maximum extent permitted by law, the Service and Output are provided “as is” and “as available” without warranties of any kind.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages.

Our aggregate liability will not exceed the total fees you paid for the relevant paid service in the 12 months prior to the event giving rise to the claim (or RMB 100 if you paid nothing), unless applicable law requires otherwise.

You agree to indemnify and hold us harmless from claims arising out of your Content, your use of the Service, or your violation of these Terms.

These Terms are governed by the laws of the People’s Republic of China (excluding conflict of laws rules).

Disputes shall be submitted to a competent People’s Court with jurisdiction in the PRC, unless mandatory law provides otherwise.

We may update these Terms from time to time by posting an updated version and changing the “Last updated” date. Continued use after changes become effective constitutes acceptance.

If there is any inconsistency between Chinese and English versions, the Chinese version prevails.
